Terms of Service

By accessing or using Analyse ("Service"), operated by VertCode Development E.E. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and the Company, governed by Regulation (EU) 2016/679 (GDPR), Greek Law N.4624/2019, Presidential Decree 131/2003 (E-Commerce), and Greek Law N.2251/1994 (Consumer Protection).

Analyse is an analytics platform for Minecraft and Hytale game servers that provides player tracking, hostname-based attribution analytics, campaign management, and revenue insights. The Service requires integration with your game server via our plugin or SDK.

The Service is provided as a Software-as-a-Service (SaaS) product accessible through the website at analyse.net and associated APIs.

To use the Service, you must:

• Create an account with accurate and complete information
• Be at least 16 years of age, or have verifiable parental or guardian consent in accordance with N.4624/2019 Art. 21
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information.

Your use of the Service is subject to our Acceptable Use Policy, which forms part of these Terms. You agree not to:

• Use the Service for any unlawful purpose under Greek or EU law
• Attempt to gain unauthorized access to our systems or infrastructure
• Interfere with, disrupt, or degrade the performance of the Service
• Resell, sublicense, or redistribute the Service without written permission
• Use the Service to collect or process personal data in violation of GDPR or N.4624/2019
• Reverse engineer, decompile, or disassemble any part of the Service

By using our plugin or SDK, you acknowledge that player data (including UUIDs, usernames, IP-derived country information, connection hostnames, and session data) will be transmitted to and processed by our Service.

As the operator of a game server using Analyse, you act as the data controller for your players' personal data under GDPR Art. 4(7). We act as the data processor under Art. 4(8). The relationship is governed by our Data Processing Agreement.

You are responsible for informing your players about this data processing and ensuring you have a valid legal basis under Art. 6 GDPR. For more details, see our Privacy Policy.

Certain features require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate and complete billing information
• Automatic renewal at the end of each billing period unless cancelled at least 24 hours before the renewal date

All prices are displayed inclusive of applicable VAT where required. Payment processing is handled by Stripe, Inc. and subject to their terms of service.

You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of the current billing period. No partial refunds are provided for unused time within a billing period.

The Service, including its source code, design, documentation, and all associated intellectual property, is owned by VertCode Development E.E. and protected by Greek, EU, and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms for the duration of your subscription. This license does not include the right to modify, adapt, or create derivative works based on the Service.

You retain full ownership of your data. By using the Service, you grant us a limited license to process your data solely as necessary to provide, maintain, and improve the Service.

We may terminate or suspend your access to the Service immediately for material violation of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You may request export of your data within 30 days of termination
• After 30 days, your data will be deleted in accordance with our data retention policies
• Any outstanding fees remain payable

You may terminate your account at any time through your account settings or by contacting us.

We may modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email or through the Service. Continued use of the Service after the effective date of changes constitutes acceptance.

If you do not agree with modified Terms, you may terminate your account before the changes take effect.

We encourage you to contact us first to resolve any disputes informally at contact@vertcodedevelopment.com.

In accordance with EU Regulation 524/2013, EU consumers may submit disputes to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

These Terms are governed by and construed in accordance with the laws of the Hellenic Republic (Greece), without regard to conflict of law provisions.

Any disputes arising under these Terms that cannot be resolved informally or through ODR shall be subject to the exclusive jurisdiction of the courts of Athens, Greece. This does not affect your rights as a consumer to bring proceedings in the courts of your place of residence.
